Liability and Limitation of Liability
The Operator makes every effort to ensure that all product information, including descriptions, specifications and photos, is accurate. Liability for the Products is subject to the applicable consumer protection laws and to the warranty attached to each Product.
The Operator shall have no liability for any direct, indirect or punitive damages of any kind incurred by You and/or any third party resulting from any use of, or reliance on, any content available on the Website.
Mistakes may be made in good faith regarding the details of the Products as they appear on the Website. You are therefore advised to read the product description carefully before placing an order.
If a product You received does not match the product You ordered, You may contact the Operator, who will issue a refund according to the price of that product and arrange its return. Alternatively, You may receive a different product and/or a refund and/or pay the price difference between the received product and the other product.
The Operator does not warrant that all links available on the Website are active and/or lead to an active website. The existence of a link does not mean that its content is reliable, accurate and/or up to date. The Operator does not control such content and shall have no liability for it.
The Operator will not be liable for damage resulting from any purchase through the Website, including, without limitation:
- a payment made without the consent or knowledge of the ordering customer;
- an error in the shipping address or credit card details;
- communication faults caused by negligence or misconduct of the telecommunication service provider.
The Operator will not be liable for any damage caused to You and/or any third party by using the Products, except for products that were defective due to the Operator's negligence. In such a case, the aggregate liability of the Operator shall not exceed the price of the defective product.
The Operator has no responsibility for any content appearing in advertisements on the Website, including commercial offers from third parties. Any claims regarding such offers should be addressed to the third party that provided them.
The Operator has agents who market the Products. The agents' activities, including any content they publish, are at their own discretion, and the Operator shall have no liability for them.
Term and Termination
This Agreement commences on the day You start using the Website and continues until You stop using the Website and the Operator's services.
The Operator may terminate this Agreement with You at any time if:
- You have breached any provision of the Agreement, or have acted in a manner which clearly shows that You do not intend to, or are unable to, comply with it;
- the Operator is required to do so by law (for example, where providing the Operator's services to You is, or becomes, unlawful);
- providing the Service is no longer commercially viable.
In such cases the Operator shall, where possible, give reasonable notice of termination.
The Operator reserves the right, at its sole discretion, to amend these Terms at any time by publishing the amendments on the Website and notifying You. Amendments come into force immediately upon notice. Your continued use of the Website will be considered consent to the amended Terms.
The Operator reserves the right to shut down the Website, or any part of it, without prior notice, and shall have no liability for any resulting damage or loss to You or any third party.
All terms of this Agreement relating to intellectual property and limitation of liability shall survive any termination of this Agreement.
